Court of Appeals Win!

Foster Swift attorneys, Allison Collins and Paul Millenbach, teamed up to score a win for their client at the Michigan Court of Appeals in a case involving the Payment of Wages and Fringe Benefits Act (PWFBA). The Court of Appeals, in reversing the Circuit Court's ruling affirming the administrative agency decision, granted leave and held that the defendant employer's requirement that the plaintiff be employed on the date that certain earnings were payable was valid and enforceable. The Court properly found that the earnings were fringe benefits, not wages, and that the parties' written agreement was clear and unambiguous, thereby reversing the erroneous findings of both the ALJ and the Circuit Court.

Collins is a member of the general litigation practice group and has extensive experience in environmental litigation in both state and federal courts. Allison's practice also includes agricultural law, criminal defense and insurance defense.

Millenbach is co-leader of the Foster Swift litigation practice group and focuses his practice in areas of Michigan no-fault litigation, including medical provider reimbursement as well as first and third party defense, transportation and logistics law and mass tort defense.
